WINS Terms of Service

1. Acceptance of terms

By creating an account or using WINS (getwinsapp.com), you agree to these Terms of Service. If you do not agree, do not use the platform. These terms apply to all users, including free and paid subscribers.

2. Description of service

WINS is a market intelligence platform for entrepreneurs and content creators. It provides tools including Niche Map, Audience Calendar, Peak Post timing, and Viral Analyzer to help users grow their online presence. Features vary by subscription plan.

3. Account registration

• You must provide a valid email address and keep your account credentials secure.
• You are responsible for all activity that occurs under your account.
• You must be at least 13 years old to use WINS.
• One account per person. Creating multiple accounts to circumvent plan limits is prohibited.

4. Subscriptions and payments

• WINS offers a free tier and paid plans (Starter and Pro) billed monthly.
• Payments are processed securely by Stripe. WINS never stores your card details.
• Subscriptions renew automatically at the end of each billing period unless cancelled.
• You may cancel at any time. Access continues until the end of the current billing period, after which your account reverts to the free plan.
• We do not offer refunds for partial billing periods.

5. Acceptable use

You agree not to:

• Use WINS for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse engineer, scrape, or extract data from the platform in bulk.
• Share, resell, or redistribute WINS data or outputs without written permission.
• Interfere with or disrupt the platform's infrastructure or other users' access.
• Use automated scripts or bots to access the platform.

6. Intellectual property

All content, design, code, and data within WINS — including market intelligence outputs, UI elements, and branding — is the property of WINS and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the platform for your personal or business purposes.

7. Third-party data and accuracy

WINS aggregates data from third-party sources including Google Trends (via DataForSEO) and social media platforms. We make reasonable efforts to provide accurate, up-to-date information but cannot guarantee the completeness or accuracy of any data. Market intelligence outputs are for informational purposes only and do not constitute business or financial advice.

8. Disclaimer of warranties

WINS is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or that the data provided will meet your specific requirements.

9. Limitation of liability

To the fullest extent permitted by law, WINS and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability to you for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account at any time if you violate these terms or engage in activity that harms the platform or other users. You may close your account at any time by contacting us. Upon termination, your access to paid features ceases immediately.

11. Changes to these terms

We may update these Terms of Service from time to time. Continued use of WINS after changes are posted constitutes acceptance of the updated terms. We will notify users of material changes by email where reasonably practicable.
